These Terms and Conditions govern your use of the EPA website and any services, products, programs, sessions, workshops, consultations, training engagements, or communications offered by Exam Preparation Academy (“EPA,” “we,” “us,” or “our”), a division of Global Human Resources Development Limited.
By accessing the website, submitting an inquiry, booking a service, making a payment, registering for a program, or otherwise using EPA’s services, you agree to be bound by these Terms and Conditions, together with our Privacy Policy and Refund Policy. If you do not agree, you must not use the website or services.
You represent that you are legally able to enter into a binding agreement or, if you are under the age of majority in your jurisdiction, that a parent, guardian, or other authorized adult has reviewed these terms and agrees to them on your behalf.
Where a parent, guardian, school representative, or corporate officer books services for another person, that person represents that they have the authority to provide instructions, share relevant information, and bind the learner, participant, or organization to the applicable service terms.
EPA provides educational support services that may include Academic Research & Scholarly Writing support, tutoring, SBA support, exam preparation, learning strategy guidance, editing, structured feedback, professional development, custom workshops, and workforce education.
EPA does not hold itself out as a degree-granting institution, testing authority, school board, licensing body, or employer unless expressly stated. EPA’s role is supportive and educational. The website and services are designed to help users prepare, improve, and perform more effectively, but EPA cannot replace a learner’s own study, effort, judgment, or institutional requirements.
EPA does not guarantee grades, passes, distinctions, admissions, scholarships, job placements, promotions, licensure, publication, or any other academic or professional result. Educational and career outcomes depend on multiple factors beyond EPA’s control, including the learner’s effort, prior knowledge, consistency, attendance, timing, institutional standards, marking practices, examiner decisions, and external conditions.
Any examples, testimonials, statements of benefit, or illustrations on the website are descriptive, not promises of a specific result.
EPA requires all users to act honestly. EPA’s services are intended to support learning, skill development, revision, structure, feedback, understanding, and performance improvement. They are not offered for cheating, impersonation, plagiarism, falsification, or any deceptive academic or professional conduct.
You agree not to use EPA’s website or services to misrepresent authorship, submit work dishonestly, sit examinations through another person, purchase undisclosed ghostwritten material for fraudulent submission, alter academic records unlawfully, or violate the rules of any school, university, examination body, employer, or regulator.
EPA reserves the right to refuse, suspend, or terminate services where it believes a request conflicts with academic integrity, professional ethics, law, or institutional rules. In such cases, EPA may retain fees already earned for work performed, to the extent permitted by law and fairness.
You agree to provide accurate information when booking or using services. You are responsible for providing correct contact details, relevant instructions, complete assignment information, schedule availability, and any materials EPA reasonably needs to deliver the service.
You are also responsible for reviewing deliverables, attending sessions on time, communicating respectfully, raising concerns promptly, and ensuring that any use of EPA’s support complies with your school, university, employer, training provider, or professional body.
EPA is not responsible for problems caused by inaccurate instructions, missing documents, late submissions from the client, failure to attend sessions, failure to respond to messages, or failure to disclose deadlines and constraints honestly.
Appointments, tutoring sessions, workshops, classes, and consultations are subject to availability. EPA may require advance booking, intake forms, payment confirmation, or deposits before a service is scheduled.
Clients are expected to attend on time. If you are late, EPA may shorten the session to preserve the schedule for others. Persistent lateness, repeated rescheduling, disruptive behavior, or non-attendance may lead to suspension of services or loss of booked time without refund, subject to the Refund Policy.
EPA may use online platforms, phone, email, messaging tools, or in-person delivery depending on the service. Clients are responsible for having suitable access to the required technology unless EPA expressly agrees otherwise.
Fees are stated in the currency published by EPA or set out in the applicable quotation, invoice, registration form, or proposal. Payment may be due in full in advance, in installments, by deposit plus balance, or under another structure stated in writing.
EPA may suspend or withhold services where payment is overdue. For ongoing services, missed installments may result in paused access, cancellation of future sessions, or withholding of materials until the account is regularized.
Clients are responsible for any taxes, transfer costs, bank charges, or processor fees where those charges are not expressly included in the quoted price.
Refunds, credits, cancellation rights, and rescheduling rules are governed by EPA’s Refund Policy, which forms part of these Terms and Conditions. In the event of conflict between a signed corporate agreement and the website Refund Policy, the signed agreement controls for that engagement.
Unless otherwise stated, the EPA website, branding, curriculum materials, slides, lesson structures, templates, workshop materials, videos, training aids, graphics, text, and related content are owned by or licensed to EPA and are protected by applicable intellectual property laws.
You may access and use EPA materials only for your personal educational use or your organization’s internal training use, as applicable. You may not copy, reproduce, resell, distribute, publish, adapt, reverse engineer, or exploit EPA materials commercially without prior written permission.
Clients retain ownership of the original documents and content they submit to EPA. However, by submitting materials to EPA, you grant EPA a limited right to use them as necessary to deliver the requested service, maintain records, conduct internal quality review, and protect legal rights.
You agree not to use the EPA website in any way that is unlawful, abusive, fraudulent, defamatory, harmful, infringing, disruptive, or technically damaging. You must not attempt to gain unauthorized access to the website, introduce malicious code, scrape content at scale without permission, interfere with website security, or use automated means to exploit forms, resources, or content.
EPA reserves the right to block access, remove submissions, or take appropriate legal or technical action where misuse is suspected.
If you post, upload, submit, or send content to EPA, you represent that you have the right to do so and that the content does not violate law, privacy rights, confidentiality obligations, or intellectual property rights. EPA is not responsible for materials unlawfully submitted by users, but EPA may remove, refuse, or report problematic content where appropriate.
EPA is not obligated to keep submitted materials indefinitely and may delete or archive them in line with its operational and retention practices.
By contacting EPA or using its services, you consent to receive communications reasonably necessary to respond to your inquiry, manage your booking, deliver services, process payment, provide reminders, send receipts, address support issues, and administer your account.
Where lawful and appropriate, EPA may also send promotional messages, and you may opt out of those communications.
EPA may rely on third-party tools for scheduling, video conferencing, payments, hosting, file sharing, analytics, messaging, and learning delivery. EPA is not responsible for downtime, outages, errors, or policy changes made by those third-party services, although EPA will act reasonably to reduce disruption where it can.
Use of third-party tools may also subject you to the terms and policies of those providers.
EPA will treat client information with care and discretion. However, ordinary educational support relationships do not create an absolute or privileged confidentiality relationship like that between attorney and client. EPA may disclose information where required by law, where necessary to protect a person’s safety, where needed to collect unpaid fees or defend legal claims, or where sharing is reasonably necessary to deliver the service through authorized staff or vendors.
Clients should not send highly sensitive information unless it is necessary for the service and appropriate safeguards are in place.
EPA may revise, withdraw, substitute, reschedule, or discontinue services, instructors, platforms, packages, or website features where reasonably necessary. EPA may also refuse service where a request is outside scope, ethically problematic, unsafe, unlawful, abusive, or operationally unworkable.
EPA will try to communicate material changes promptly, but it cannot guarantee uninterrupted website access or constant availability of every offering.
EPA may suspend or terminate access to the website or services if a user breaches these Terms, violates academic integrity standards, mistreats staff, fails to pay, misuses platforms, engages in fraud, or creates legal, reputational, or operational risk.
The client may stop using EPA’s services at any time, but payment obligations, non-refundable fees, and obligations tied to already-delivered work remain governed by these Terms and the Refund Policy.
The EPA website and services are provided on an “as available” and “as reasonably offered” basis. To the fullest extent permitted by law, EPA disclaims warranties not expressly stated, including implied warranties of uninterrupted availability, fitness for a particular purpose, merchantability, or guaranteed educational or business outcomes.
This disclaimer is not intended to exclude any right or protection that cannot legally be excluded under applicable law.
To the fullest extent permitted by applicable law, EPA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, loss of business opportunity, loss of reputation, loss of data, exam failure, missed academic deadlines caused by client-side delay, or professional disappointment arising out of or related to the website or services.
Where liability cannot lawfully be excluded, EPA’s aggregate liability for any claim relating to a paid service will generally be limited to the amount actually paid by the client for the specific service giving rise to the claim, unless a different limit is required by law or expressly agreed in writing.
You agree to indemnify and hold harmless EPA, Global Human Resources Development Limited, and their officers, staff, tutors, consultants, and agents from claims, liabilities, losses, costs, and expenses arising from your misuse of the website, your breach of these Terms, your unlawful conduct, your violation of third-party rights, or your dishonest or prohibited use of EPA’s services.
This clause will be interpreted reasonably and only to the extent permitted by law.
These Terms and Conditions are governed by the laws of Jamaica, unless EPA expressly states otherwise in a specific contract.
Before filing legal proceedings, the parties agree to attempt good-faith resolution by written notice to the other party, setting out the issue and the remedy sought. If the dispute is not resolved within a reasonable period, either party may pursue any remedy available under applicable law and before the appropriate court or tribunal.
If EPA enters into a separate corporate contract that includes a different dispute-resolution clause, that clause will control for that engagement.
If any provision of these Terms and Conditions is found unenforceable or invalid, the rest will remain in full force to the extent legally possible. The unenforceable provision will be interpreted as closely as possible to its original purpose.
These Terms and Conditions, together with the EPA Privacy Policy, Refund Policy, and any accepted proposal, invoice, statement of work, or corporate service agreement, form the complete understanding between the parties regarding the relevant service, except where a later signed agreement expressly overrides them.
EPA may update these Terms and Conditions from time to time. The updated version will be posted on the website with a revised effective date. Continued use of the website or services after the effective date of an updated version constitutes acceptance of the revised terms to the extent permitted by law.
